By accessing or using Qviple, you agree to these Terms & Conditions. These terms apply to all websites, apps, dashboards, modules, and services provided by Mithkal Minds Private Limited.
Qviple supports educational institutions, administrators, teachers, students, parents, and related users. You are responsible for using the service lawfully and for ensuring that information submitted through your account is accurate.
2. License
Qviple grants you a limited, revocable, non-exclusive, non-transferable license to access and use the service for institutional, academic, administrative, and learning purposes permitted by your role.
This license does not transfer ownership of Qviple software, design, content, documentation, workflows, trademarks, or intellectual property.
3. Definitions and Key Terms
- Cookie
- A small data file placed on a browser or device to remember preferences, sessions, analytics, and security choices.
- Company
- Mithkal Minds Private Limited, owner and operator of Qviple.
- Country
- India.
- Device
- Any internet-connected phone, tablet, computer, or other hardware used to access the service.
- Service
- The Qviple website, web application, mobile applications, dashboard, LMS, ERP modules, and related institutional services.
- Third-party Service
- Any external provider, integration, payment gateway, analytics tool, hosting service, or linked platform used with Qviple.
- Website
- Qviple websites and subdomains, including qviple.com and related service domains.
- You
- The person, institute, administrator, staff member, student, parent, guardian, or entity accessing or using Qviple.
4. Restrictions
- Do not copy, sell, resell, lease, sublicense, reverse engineer, or misuse any part of Qviple.
- Do not bypass access controls, security systems, payment flows, usage limits, or institute permissions.
- Do not upload unlawful, harmful, infringing, misleading, abusive, or unsafe content.
- Do not interfere with service availability, data integrity, or other users' access.
5. Payment Refund Policy
Refund requests for eligible non-institute payments should be raised within 48 hours of the transaction.
Qviple processes payments to institutions where applicable. Institute-related payments, including ID card fees, admission fees, and fees paid directly to an institute, must be handled with that institute.
- Only non-institute payments can be refunded by Qviple where eligible.
- Non-institute payments may include application fees, e-content purchases, and subscription fees.
- Student refunds for institutional payments are processed by the concerned institution.
6. Return and Refund Policy
Digital services, application processing, subscriptions, and e-content may have limited refund availability once accessed, delivered, or processed.
Approved refunds are returned through the original or supported payment method, subject to payment gateway timelines and verification requirements.
7. User Suggestions
If you share ideas, feedback, improvements, or suggestions with Qviple, you allow Qviple to use them without restriction or compensation for product improvement, support, and service development.
8. User Consent
By creating an account, signing in, submitting information, making payments, or continuing to use Qviple, you consent to these terms and related policies, including the Privacy Policy.
9. User Commitment / Who Can Use Qviple
You must be authorized to use Qviple for your institution or personal academic role. Users must be at least 13 years old to use Qviple independently, or use must occur with parent or legal guardian involvement where applicable.
Institution administrators are responsible for assigning roles, maintaining permissions, and ensuring that institute users follow applicable law and policy.
10. Prohibited Use
- Impersonation, fraud, harassment, abuse, discrimination, or illegal activity.
- Uploading malware, spam, exploit attempts, or content that harms children or violates safety laws.
- Collecting user information without authority or using data outside permitted educational and institutional purposes.
- Attempting unauthorized access to accounts, dashboards, databases, infrastructure, or payment systems.
11. Permissions Given by Users
You grant Qviple permission to host, process, transmit, display, and store content and data submitted through the service as needed to operate Qviple, provide support, secure accounts, process transactions, and deliver institute workflows.
12. Additional Rights Reserved by Qviple
Qviple may update features, enforce usage policies, suspend unsafe activity, restrict access, investigate abuse, and take steps needed to protect users, institutions, platform integrity, and legal compliance.
13. Deleting Content and Disabling Account
Account or content deletion requests can be sent to Qviple through support or contact channels. Deletion starts within 30 days after a valid request and may take up to 90 days to complete.
Some records may be retained where required for legal, security, payment, audit, institutional, dispute-resolution, or compliance reasons.
14. Links to Other Websites
Qviple may link to third-party websites or services. Qviple is not responsible for third-party content, policies, security, availability, or practices.
15. Cookies
Qviple may use cookies and similar technologies to keep users signed in, remember preferences, improve performance, detect misuse, and understand service usage.
16. Changes to Terms & Conditions
Qviple may update these Terms & Conditions from time to time. Continued use after changes means you accept the updated terms.
17. App Modifications and Updates
Qviple may modify, add, remove, suspend, or discontinue features, modules, integrations, or apps to improve reliability, security, compliance, and user experience.
18. Third-Party Services
Some features depend on third-party providers such as hosting, analytics, maps, payment gateways, authentication, communication, or support tools. Their separate terms may apply.
19. Term and Termination
These terms remain effective while you use Qviple. Qviple may suspend or terminate access if you violate these terms, create risk, breach law, or misuse the service.
20. Copyright Infringement Notice
If you believe content on Qviple infringes your copyright, contact connect@qviple.com with enough detail to identify the work, the alleged infringement, your contact information, and a good-faith statement.
21. Indemnification
You agree to defend, indemnify, and hold Qviple, Mithkal Minds Private Limited, personnel, partners, and affiliates harmless from claims, losses, liabilities, and expenses arising from your misuse, content, violation of law, or breach of these terms.
22. No Warranties
Qviple is provided on an as-is and as-available basis. Qviple does not guarantee uninterrupted availability, error-free operation, or that every feature will meet every specific requirement.
23. Limitation of Liability
To the maximum extent permitted by law, Qviple and Mithkal Minds Private Limited are not liable for indirect, incidental, special, consequential, punitive, or loss-of-data damages arising from service use or inability to use the service.
24. Severability
If any part of these terms is held invalid or unenforceable, the remaining parts continue in effect to the fullest extent permitted by law.
25. Waiver
A delay or failure by Qviple to enforce any term is not a waiver of that term or any other right.
26. Amendments
Qviple may amend these terms to reflect product, legal, security, operational, or policy changes.
27. Entire Agreement
These terms, together with the Privacy Policy and any applicable institute or product terms, form the agreement between you and Qviple for service use.
28. Updates to Terms
Updated terms may be posted on this page or communicated through the service. You should review this page periodically.
29. Intellectual Property
Qviple software, workflows, branding, documentation, interface elements, and content are protected by intellectual property laws. You may not use Qviple marks or materials without written permission unless allowed by law or a written agreement.
30. Agreement to Arbitrate
Where legally permitted, disputes related to these terms or Qviple should first be resolved through good-faith discussion and then through arbitration under applicable Indian law.
31. Notice of Dispute
Before starting formal proceedings, send a written dispute notice to connect@qviple.com with your name, contact details, issue summary, and requested resolution.
32. Binding Arbitration
If a dispute is not resolved informally, it may be referred to binding arbitration according to applicable Indian arbitration law, subject to any mandatory court rights that cannot be waived.
33. Submissions and Privacy
Submissions made through Qviple are handled according to the service workflow and Privacy Policy. Do not submit information you are not authorized to provide.
34. Promotions
Any contests, offers, promotions, surveys, or campaigns may have separate rules. If there is a conflict, those specific rules apply to that promotion.
35. Typographical Errors
Qviple may correct typographical mistakes, pricing errors, inaccurate descriptions, or accidental omissions without liability, subject to applicable law.
36. Miscellaneous
Headings are for convenience only. These terms do not create an agency, partnership, employment, or joint venture relationship unless expressly agreed in writing.
37. Disclaimer
Qviple supports institutional management and learning workflows. Institutions remain responsible for academic decisions, fee decisions, admissions, records, communication, and compliance obligations within their authority.
